StarStory respects your privacy and understands that the information customers share with us may include personal information and photographs relating to children.

This Privacy Policy explains how Bolton AI Studio LLC, doing business as StarStory (“StarStory,” “we,” “us,” or “our”), collects, uses, shares, stores, and protects information when you (alternatively referred to herein as, “customer”) visit GetStarStory.com, submit a StarStory order, upload photographs or other content, communicate with us, or otherwise use our services.

StarStory’s ordering and intake services are intended for adult customers age 18 and older. A child or minor may be the subject or recipient of a StarStory, but children and minors should not independently place orders or submit personal information, photographs, or other content directly to StarStory.

1. Information We Collect

When you order a StarStory, complete our intake form, communicate with us, or request a revision, we may collect your name, email address, order information, information about the person for whom the StarStory is being created, the subject’s age, interests, hobbies, goals, accomplishments, personality traits, preferences, physical descriptions, photographs, instructions, comments, creative preferences, revision requests, and communications you send to us.

We do not currently ask for a customer phone number, mailing address, a child’s last name, or a child’s date of birth as part of the standard intake process. We ask customers not to provide information that is unnecessary for creating or supporting their StarStory.

Because StarStory creates personalized songs and videos, adult customers (including you, should you be an adult) may provide personal information about another person, including a child. When you provide information or photographs concerning another person, you as a parent or guardian of such child represent that you have the authority and permission necessary to provide that information to us. YOU ARE NOT AUTHORIZED AND DO NOT HAVE PERMISSION BY US TO PROVIDE US WITH INFORMATION OR PHOTOGRAPHS OF ANY CHILD TO WHOM YOU ARE NOT THEIR PARENT OR GUARDIAN OR AN ADULT WHO HAS AUTHORIZATION FROM THE MINOR’S PARENT OR LEGAL GUARDIAN. If we are informed and other determine that you are not the parent or guardian of a child (or an adult who has authorization from the minor’s parent or legal guardian) that is the subject of information or photograph(s) that you provided StarStory, we will promptly cancel your order with us, and delete such information or photograph(s), and not fulfill any order you have placed with us.

2. Children’s Information

StarStory creates personalized products that are often made for children, but StarStory’s ordering and intake services are intended for adults age 18 and older.

A child or minor may be the subject or recipient of a StarStory, but children and minors should not independently place orders or submit their personal information, photographs, or other content directly to StarStory.

When an adult customer submits personal information or photographs concerning a person under 18, the customer represents and warrants that the customer is the minor’s parent or legal guardian, or an adult who has authorization from the minor’s parent or legal guardian to provide the information and photographs for creation of the StarStory.

StarStory does not intend to collect personal information directly from anyone under 18. In particular, federal children’s privacy law provides additional protections regarding the online collection of personal information from children under 13. If we learn that personal information has been submitted directly by a person under 18 rather than by an authorized adult customer, we may take appropriate steps to delete the information.

If you believe that a child or an adult has independently provided personal information or photographs of a child to StarStory without appropriate authorization, contact support@getstarstory.com.

3. Photographs Uploaded by Parents or Guardians

Photographs used to create a StarStory are submitted through our intake form by an adult customer age 18 or older. When a photograph depicts a minor, the customer must be the minor’s parent or legal guardian or an adult who has authorization from the minor’s parent or legal guardian to provide the photograph for creation of the StarStory.

Photographs are currently collected through our intake form. We use uploaded photographs only as reasonably necessary to create the personalized StarStory, process the photographs through necessary creative tools, deliver the completed StarStory, provide customer support, and complete an eligible revision during the revision period.

We do not use uploaded photographs to advertise StarStory without permission. Submitting a photograph does not give StarStory permission to publicly display it or use the photograph or child’s likeness in advertising, social media, promotional materials, demonstrations, or marketing.

4. Our 7-Day Photo Deletion Policy

To help protect the privacy of children and other StarStory subjects, uploaded customer photographs are deleted by StarStory after the (7)-day revision period following delivery of the completed StarStory.

Customers must submit any photo-related revision request within 7 calendar days of delivery. After the revision period ends and source photographs have been deleted, we may no longer be able to perform revisions requiring those photographs.

Deletion of the originally uploaded photographs does not necessarily mean that the completed StarStory video is deleted. We may retain the completed StarStory and appropriate order records for customer service, business, legal, security, and operational purposes.

5. How We Use Personal Information

Receive and process orders and create personalized songs and videos.

Personalize the StarStory based on customer instructions and process submitted photographs and content.

Communicate with customers, deliver completed StarStories, provide customer support, and process eligible revisions.

Process payments and maintain transaction records.

Prevent fraud, misuse, or unauthorized activity.

Troubleshoot and improve our website and services.

Understand website usage and measure website performance and advertising effectiveness.

Maintain security, comply with law, enforce our Terms & Conditions, and establish, exercise, or defend legal rights.

Help detect, investigate, and address suspected fraud, misuse, security incidents, or unauthorized activity.

6. Artificial Intelligence and Creative Service Providers

The StarStory service uses artificial-intelligence model(s) and other digital creative technologies as part of producing personalized songs and videos. Information or content supplied by an authorized adult customer may be processed using third-party AI models (such as, e.g., ChatGPT), image-generation, music-generation, animation, video-production, editing, hosting, storage, or other creative technology providers. Photographs, descriptions, prompts, or other Customer Content may be transmitted to or processed by such third-party service providers only as reasonably necessary to create, process, deliver, support, or revise the purchased StarStory or operate the service. We have the right in our sole discretion to change any third-party models used for the StarStory service at any time. However, the privacy policy of any current or third party service used for providing at least part of the StarStory service shall have a privacy policy at least as rigorous as StarStory’s privacy policy.

7. Our Intake Form

StarStory currently uses a third party service to help collect information submitted through our customer intake form. Information entered into the intake form, including photographs uploaded by an adult parent, guardian, or authorized customer, may therefore be processed through such third-party’s systems as part of the order-submission process. At present, we use Tally BV for providing and processing our customer intake form. We reserve the right to replace Tally BV or use additional providers in the future without notice as long as replacement or additional provider have applicable Privacy Policies at least as rigorous as the terms of this Privacy Policy.

8. Payments

StarStory currently uses a third-party payment processing service to process customer payments. Payment information submitted during checkout may be collected and processed directly by such third-party payment processing service rather than stored directly by StarStory. StarStory may receive transaction information necessary to confirm and maintain records of your purchase. At present, we use Stripe, LLC for providing and processing payment for our customer intake form. We reserve the right to replace Stripe, LLC or use additional providers in the future without notice as long as the replacement or additional provider have applicable Privacy Policies at least as rigorous as the terms of this Privacy Policy.

9. Website Usage Information

When you visit GetStarStory.com, we and service providers working on our behalf may automatically collect technical information such as IP address, browser type, device type, operating system, pages visited, referring source, approximate geographic information derived from an IP address, visit times, and interactions with pages or advertisements.

10. Cookies, Analytics, and Advertising Technologies

StarStory may use cookies, pixels, tags, scripts, and similar technologies to operate the website, understand traffic, improve the customer experience, measure advertising performance, and understand how visitors discover and interact with StarStory. These technologies may include services such as Google Analytics, Meta/Facebook Pixel, and similar analytics or advertising tools. Where required by applicable law, we will provide appropriate choices regarding non-essential cookies or similar technologies.

11. How We Share Information

StarStory does not sell customer photographs. We may disclose personal information to service providers that help us operate StarStory, including website hosting, form and intake, cloud storage, payment processing, AI and creative production, image/music/animation/video production, email and communications, analytics, advertising and measurement, fraud prevention and security, and professional advisers. We may also disclose information when reasonably necessary to comply with law, respond to valid legal process, protect rights or safety, investigate fraud, or abuse, or enforce our agreements.

12. Advertising and Customer Photos

StarStory may use advertising and analytics technology to measure and promote our business. However, we will not use an uploaded customer photograph, a child’s likeness, or a customer’s completed personalized StarStory in StarStory advertising or promotional materials without permission. If we would like to feature a particular StarStory, photograph, testimonial, or customer story, we will request permission separately.

13. Marketing Communications

StarStory may send transactional or service-related communications necessary to process and support an order, including order confirmations, requests for information, delivery notices, revision communications, and customer-service messages. We may also send promotional or marketing emails about StarStory products, services, offers, or updates, where permitted by applicable law. Recipients may opt out of promotional emails at any time using the unsubscribe method provided in those communications.

StarStory does not currently send marketing text messages. If we introduce a promotional text-message program in the future, we will provide any notices and obtain any consent required by applicable law.

14. How Long We Keep Information

We retain personal information only for as long as reasonably necessary for the purposes for which it was collected and for legitimate business, customer-service, security, accounting, tax, fraud-prevention, and legal purposes. Uploaded photographs are deleted after the 7-day revision period following delivery. We may retain completed songs and videos for customer service, operational, recordkeeping, and related legitimate business purposes. Order, transaction, intake, and customer communication records may be retained as reasonably necessary for business, tax, legal, fraud-prevention, customer-service, and dispute-resolution purposes.

15. Security

We use reasonable administrative, technical, and organizational measures designed to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure. However, no website, internet transmission, cloud service, AI system, storage system, or electronic database can be guaranteed completely secure.

16. Your Privacy Choices and Requests

You may contact StarStory at support@getstarstory.com to request information about personal information we maintain about you, correction of inaccurate information, deletion of personal information associated with you or your child, or to raise another privacy concern. We may need to verify your identity or authority to make a request involving another person or child. Certain information may need to be retained where reasonably necessary or legally required.

17. U.S. State Privacy Rights

Residents of certain U.S. states may have additional privacy rights under applicable state law, including rights relating to access, correction, deletion, copies of information, and certain disclosures or uses. Certain state laws may also provide rights concerning targeted advertising, the sale or sharing of personal information, or certain automated processing activities. Where such laws apply to StarStory, we will honor legally required privacy rights.

18. Privacy and Data Practices

StarStory does not sell customer photographs or children’s photographs for money. Photographs submitted to create a StarStory are handled as described in this Privacy Policy, including our 7-day photo deletion policy.

19. Advertising Technologies and State Privacy Choices

Certain state privacy laws use technical definitions of terms such as “sale” or “sharing” that may include information transmitted through advertising cookies, pixels, or similar technologies, such as the Meta Pixel, even when no money is exchanged and customer or children’s photographs are not being sold. To the extent applicable law provides a right to opt out of such activity, StarStory will provide the legally required method for exercising that choice.

20. Third-Party Websites and Services

Our website or communications may contain links to websites or services operated by third parties. StarStory does not control the privacy practices of independent third parties. If you interact directly with another service, that company’s privacy policy and practices may apply.

21. No Customer Accounts

StarStory does not currently require customers to create a StarStory account. Information is collected as necessary to process orders, create personalized products, deliver completed StarStories, and provide customer support. If account functionality is introduced in the future, we may update this Privacy Policy.

22. Business Transfers

If Bolton AI Studio LLC or StarStory is involved in a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar business transaction, information maintained by the business may be transferred as part of that transaction, subject to applicable law. This provision does not alter our stated retention and deletion practices for uploaded photographs.

23. Legal Requirements and Protection of Rights

We may preserve or disclose information if we reasonably believe doing so is necessary to comply with applicable law or valid legal process, respond to lawful government requests, investigate or respond to suspected fraud, abuse, unauthorized activity, or security incidents, protect the rights, property, or safety of StarStory, our customers, children, or others, or establish, exercise, or defend legal claims.

24. Changes to This Privacy Policy

We may update this Privacy Policy as StarStory evolves, our technology or service providers change, or privacy laws and requirements change. When we make changes, we will update the “Last Updated” date. If a change materially affects how we handle personal information, we will provide additional notice when required by applicable law.
