Welcome to StarStory. StarStory is a personalized digital entertainment service operated by Bolton AI Studio LLC, a Florida limited liability company. Throughout these Terms & Conditions (“Terms”), “StarStory,” “we,” “us,” and “our” refer to Bolton AI Studio LLC and the StarStory brand.
These Terms govern your access to and use of GetStarStory.com, as well as your purchase and use of personalized StarStory products and related services (collectively, the “Services”). By visiting our website, submitting information or photographs, placing an order, purchasing a StarStory, or otherwise using our Services, you (alternatively referred to herein as “customer”) agree to these Terms and our Privacy Policy.
IMPORTANT: These Terms contain a binding individual arbitration agreement and class-action waiver that affect your legal rights. Please review the Dispute Resolution sections carefully.
If you do not agree to these Terms, you should not use our Services or place any order with us.
1. Who May Use StarStory
You must be at least 18 years old to place an order, make a purchase, submit Customer Content, or otherwise use StarStory as a customer.
StarStory products may be created for children and minors of any age. However, an order involving a person under 18 years old must be submitted by the minor’s parent or legal guardian, or by another adult who has authorization from the minor’s parent or legal guardian to provide the minor’s information and photographs for creation of the StarStory.
By placing an order involving a minor or submitting information or photographs relating to a minor, you represent and warrant that (a) you are at least 18 years old; you are the minor’s parent or legal guardian, or have authorization from the minor’s parent or legal guardian; (b) the information or photographs you provide us are NOT false, inaccurate, or misleading information regarding the minor’s identity, age, relationship to the subject; (c) you have the authority or permission to submit content or create a StarStory for another person; and (d)you have authority to authorize StarStory and its service providers to use the submitted information and photographs as described in these Terms and our Privacy Policy.
Children and minors should not independently submit orders, personal information, photographs, or other Customer Content directly to StarStory.
YOU ARE NOT AUTHORIZED AND DO NOT HAVE PERMISSION BY US TO PROVIDE US WITH INFORMATION OR PHOTOGRAPHS OF ANY CHILD TO WHOM YOU ARE NOT THEIR PARENT OR GUARDIAN OR AN ADULT WHO HAS AUTHORIZATION FROM THE MINOR’S PARENT OR LEGAL GUARDIAN. If we are informed and other determine that you are not the parent or guardian of a child (or an adult who has authorization from the minor’s parent or legal guardian) that is the subject of information or photograph(s) that you provided StarStory, we will promptly cancel your order with us, and delete such information or photograph(s), and not fulfill any order you have placed with us.
At this time, StarStory accepts orders only from customers located in the United States.
2. What StarStory Provides
StarStory creates customized digital song and video packages using information, preferences, descriptions, photographs, and other material supplied by customers.
Our services provide personalized creative works and may incorporate human creative direction together with third party artificial intelligence model-generated and third-party technology used for music generation, image generation, animation, editing, and other creative production processes.
Because StarStories are custom creative products, individual results will vary. Samples and advertisements illustrate the general nature of our Services and do not guarantee an identical appearance, sound, style, pacing, imagery, animation, or emotional effect.
StarStory videos are not traditional fully animated or live-action videos. They are personalized visual stories created primarily from a sequence of AI-generated or AI-assisted images, which may include animation, movement, transitions, visual effects, and other motion elements. The amount and type of motion may vary throughout each StarStory.
3. Artificial Intelligence and Creative Variations
The StarStory service may use third-party artificial-intelligence (“AI”) model(s), and other AI-assisted creative tools as part of its production process. AI-assisted creation is inherently variable. AI-generated or AI-assisted material may contain unexpected creative interpretations; exact facial likeness, body appearance, clothing, scenery, movements, expressions, voices, musical styles, or other details cannot be guaranteed; and AI systems may occasionally generate inaccuracies, artifacts, inconsistencies, or other imperfections.
Subjective dissatisfaction with an artistic choice does not automatically entitle a customer to a refund. Our revision policy below is intended to address reasonable requested adjustments.
AI-generated animated characters are created for artistic and illustrative purposes. Except for the person a character is intentionally designed to represent based on Customer Content, any resemblance to another actual person, living or deceased, is coincidental and unintended.
4. Information You Provide
The quality and personalization of a StarStory depend heavily on the information including photographs submitted to us. You are responsible for providing information that is reasonably accurate, complete, and appropriate for the StarStory you are requesting.
StarStory is not responsible for errors in a finished product that result from inaccurate, misspelled, incomplete, misleading, or incorrect information supplied by the customer. Please carefully review the information you submit before completing your order.
5. Photographs and Other Customer Content
You may provide photographs, descriptions, names, text, and other material in connection with your order (“Customer Content”). You retain whatever ownership rights you have in your original Customer Content.
By submitting Customer Content, you represent and warrant that you own or have all permissions necessary to provide such Customer Content; our use to fulfill your order will not violate another person’s rights; and the content is lawful and appropriate.
Where Customer Content depicts or concerns a person under 18 years old, you represent and warrant that you are the minor’s parent or legal guardian or are an adult who has authorization from the minor’s parent or legal guardian to submit that content and authorize its use as described in these Terms and our Privacy Policy.
You grant StarStory a limited permission to access, process, reproduce, modify, and use Customer Content only as reasonably necessary to create, deliver, support, and revise the StarStory you ordered.
Providing photographs to StarStory does not give us permission to use your photographs, a child’s likeness, or your completed StarStory for advertising or promotional purposes.
For any StarStory involving a minor, your authorization must cover not only the submission of the minor’s photographs and personal information, but also StarStory’s use of those materials to create the particular personalized content requested in the order.
You are not authorized to provide us with false, inaccurate, or misleading information regarding their identity, age, relationship to the subject, ownership of submitted content, or authority or permission to submit content or create a StarStory for another person. StarStory may rely on the representations, warranties, and consent acknowledgments provided by you.
6. Children’s Photos and Our 7-Day Deletion Policy
To help protect the privacy of children and other StarStory subjects, uploaded customer photographs are deleted by StarStory after the 7-day revision period following delivery of the completed StarStory.
Because those photographs will no longer be available to us after that period, all revision requests must be submitted within 7 calendar days of delivery. Customers are responsible for downloading and retaining their completed StarStory.
Deletion of the originally uploaded photographs does not necessarily mean that the completed StarStory video is deleted. We may retain the completed StarStory and appropriate order records for customer service, business, legal, security, and operational purposes.
It should be understood that we cannot control the retention, backup and storage polices of the third-party artificial-intelligence (“AI”) model(s) and other AI-assisted creative tools that we use, but we will endeavor to utilize those third-party service providers with commercially-reasonable retention, backup and storage polices.
7. Marketing and Promotional Use
StarStory will never use a customer’s uploaded photographs, a child’s likeness, or a generated personalized StarStory in advertising, social media, promotional materials, portfolio materials, demonstrations, or other marketing without permission. If we would like to feature a customer’s StarStory, we will request permission separately. Purchasing a StarStory does not constitute consent to promotional use.
8. Orders and When Production Begins
Because each StarStory is individually created, production is scheduled to begin 24 hours after a completed order is submitted. An order is considered submitted when we have received payment and the information and materials reasonably required to begin creating the StarStory.
The first 24 hours following submission provide the customer with an opportunity to cancel before custom production begins. Once the 24-hour period has expired and production has begun, the order becomes a customized work in progress.
9. Cancellations and Refunds
You may request cancellation and a refund before production begins. Cancellation requests should be sent to support@getstarstory.com within 24 hours after submission of a completed order.
Once production has begun, the order is custom-made specifically for the recipient and is non-refundable, except where otherwise required by applicable law. If StarStory is unable to fulfill an order, we may cancel the order and refund the amount paid.
StarStory may cancel an order at any time if we determine that the requested content violates these Terms or is a personalized StarStory we decline to create, especially pursuant to Section 18 herein.
10. Revisions
Each StarStory purchase includes one complimentary revision. The revision request must be submitted within 7 calendar days after delivery.
The complimentary revision is intended for reasonable corrections or adjustments based on the information and direction included in the customer’s original submission. It does not include an entirely new concept, substantially different creative direction, a new song or video from the beginning, substantial new information, a change of recipient or purpose, or requests submitted after the 7-day revision period.
StarStory will determine, acting reasonably, in its sole discretion whether a requested change falls within the complimentary revision. Additional or substantially different work may require an additional fee or a new order.
11. Delivery
Our normal target turnaround time is approximately 5–7 business days from submission of a completed order. This is an estimate rather than a guaranteed delivery date.
Production time may be affected by order volume, technical problems, third-party services, incomplete customer information, requested changes, holidays, or circumstances outside our reasonable control.
Customers are responsible for reviewing the completed StarStory before publicly sharing, publishing, or distributing it. If you identify a material factual error, inappropriate generated element, or other issue that may qualify for the complimentary revision, you should notify StarStory within the 7-day revision period.
12. Digital Delivery and Customer Copies
StarStories are delivered as digital products. Once your StarStory has been delivered, you are responsible for downloading and maintaining your own copy. We do not represent or guarantee that completed personalized StarStory files will remain stored or available for re-download indefinitely. We strongly recommend saving a backup copy.
After delivery, the customer is responsible for how the completed StarStory is downloaded, copied, displayed, shared, published, or distributed. Any sharing or distribution must comply with these Terms and applicable law. StarStory is not responsible for a customer’s unauthorized, harmful, unlawful, or otherwise improper use or distribution of a completed StarStory.
StarStory does not guarantee that a completed song or video will be accepted, displayed, played, monetized, or remain available on any particular third-party platform, including social-media, video-sharing, messaging, music, or other services. Third-party platforms may crop, compress, mute, block, remove, restrict, or otherwise alter content under their own rules and technologies.
StarStory delivers completed products in standard digital formats selected by StarStory. We do not guarantee compatibility or playback on every device, television, computer, operating system, application, browser, or third-party service.
13. Prices and Payment
Prices are displayed at the time an order is placed and may change from time to time. Payment processing is handled by Stripe or other payment processors we may use in the future.
By submitting payment information, you represent that you are authorized to use the payment method provided. Applicable taxes may be added where required by law.
14. Ownership of StarStory and Your Personal-Use License
StarStory and its licensors retain all their respective rights in and to the StarStory service, brand, website, production methods, technology, templates, design systems, workflows, software, prompts, production elements, and other intellectual property.
To the extent StarStory owns or has the legal right to license elements contained in your completed StarStory, your purchase gives you a limited, non-exclusive, non-transferable license and right for personal, non-commercial use of the completed StarStory within the territory of the United States.
You may download your StarStory, save copies for personal use, show it to friends and family, play it at personal celebrations and family events, and share it through personal social-media accounts, provided the use is non-commercial and within the territory of the United States.
15. Uses That Are Not Permitted
Sell, resell, or license a StarStory to another person or business.
Use a StarStory in advertising, paid promotions, commercial campaigns, television programming, films, commercial websites, commercial products, or other revenue-generating activities without written permission.
Monetize or commercially exploit a StarStory.
Register or attempt to register a StarStory or any portion of it in an automated rights-management or Content ID system.
Distribute a StarStory commercially through music-streaming or music-distribution platforms.
Use StarStory content, systems, outputs, or materials to train, develop, test, or improve an artificial-intelligence or machine-learning model.
Represent that you created or own StarStory’s software, systems, technology, production methods, or proprietary materials.
Reverse engineer, scrape, copy, reproduce, or attempt to extract StarStory’s underlying software, systems, prompts, methods, or processes.
Use StarStory or a StarStory product in violation of any applicable federal, state, or local law or regulation, or in violation of the rights of another person.
16. StarStory Name, Website, and Intellectual Property
The StarStory name, logos, branding, website design, graphics, text, service presentation, and other proprietary materials are intellectual property owned or controlled by, or licensed, to Bolton AI Studio LLC and are protected by applicable intellectual-property laws. Nothing in these Terms grants you the right to use StarStory trademarks, logos, or branding for commercial purposes without written permission from us.
17. Third-Party Technology and Services
StarStory may rely on third-party technology and service providers to help create, process, host, deliver, or support personalized products, including AI platforms, payment processors, hosting providers, communications providers, and creative tools. We do not control every aspect of those systems and cannot guarantee uninterrupted or error-free operation.
18. Prohibited Customer Content and Conduct
You may not use StarStory to create or submit unlawful, infringing, exploitative, abusive, fraudulent, malicious, or otherwise prohibited material, including content that exploits or endangers a child. We may reject, suspend, or cancel an order that we reasonably believe violates these Terms or creates legal, safety, privacy, or intellectual-property concerns.
StarStory reserves the right, in its reasonable discretion, to refuse, cancel, or decline to create any order or requested content that we believe is unlawful, hateful, racist, discriminatory, sexually explicit, exploitative, threatening, harassing, defamatory, violent, abusive, offensive, inappropriate for our service, or otherwise inconsistent with StarStory’s standards or values. We are not required to create content merely because a customer has submitted or paid for an order. If we decline an order before production for one of these reasons, we will refund the amount paid, unless the order involves fraud, abuse, or other circumstances in which a refund is not required by law.
Customers may not request or submit instructions asking StarStory to reproduce, imitate, or incorporate copyrighted characters, trademarked brands, celebrity likenesses, copyrighted songs, protected fictional characters, or other third-party intellectual property unless the customer has the legal right or permission to do so. StarStory may reject, modify, or require changes to any request that we believe may infringe, misappropriate, or otherwise violate third-party rights.
StarStory may not be used to bully, harass, humiliate, ridicule, embarrass, threaten, deceive, exploit, or intentionally cause emotional harm to another person. Customers may not create a StarStory as a malicious prank or use a person’s name, photograph, likeness, or personal information to portray that person in a knowingly false, degrading, sexually suggestive, discriminatory, or otherwise harmful manner without appropriate authorization.
When the subject of a StarStory is under 18, the customer must have authorization from the minor’s parent or legal guardian to submit the minor’s information or likeness and to request the particular type of personalized content being created. StarStory may reject or cancel an order that we reasonably believe may be intended to bully, harass, humiliate, exploit, deceive, or harm the subject or another person, even if the customer has completed required consent acknowledgments.
StarStory may not be used to impersonate another person for fraudulent, deceptive, defamatory, exploitative, or harmful purposes, or to falsely represent that an AI-generated depiction, statement, action, or event is authentic.
StarStory will not create sexually explicit, sexually suggestive, exploitative, or otherwise inappropriate depictions of minors.
If StarStory later learns that an order involved stolen or unauthorized content, false consent, misuse of a minor’s likeness, bullying, fraud, or another material violation of these Terms, StarStory may, where technically possible, disable hosted access, remove content from systems under our control, preserve information as legally required, or take other reasonable protective action. StarStory cannot remove or control copies that have already been downloaded, copied, or distributed by a customer or third party.
19. Copyright and Intellectual-Property Complaints
If you believe material associated with the Services infringes rights you own or are authorized to enforce, contact support@getstarstory.com with enough information to identify and verify the claimed infringement, the material involved, your rights, and how to contact you.
20. Feedback
If you voluntarily send StarStory suggestions, ideas, comments, feature recommendations, or other feedback about our Services, you hereby authorize us to use without limitation that feedback to improve or develop StarStory without compensation or obligation to you. This does not give StarStory permission to use a child’s photographs or information for advertising.
21. No Guarantee of Particular Creative Results
Creative preferences are subjective. While we make reasonable efforts to create a high-quality personalized experience, we cannot guarantee that every customer or recipient will have the same reaction to a song, illustration, animation, story, voice, musical style, visual interpretation, or other creative element. Except for the revision rights described in these Terms, personal preference alone does not create a right to a refund or complete remake.
22. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND STARSTORY PRODUCTS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. EXCEPT FOR PROMISES EXPRESSLY STATED IN THESE TERMS, STARSTORY DISCLAIMS WARRANTIES AND REPRESENTATIONS, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, UNINTERRUPTED AVAILABILITY, AND ERROR-FREE OPERATION, TO THE EXTENT LAWFULLY PERMITTED. NOTHING IN THESE TERMS EXCLUDES CONSUMER RIGHTS THAT APPLICABLE LAW DOES NOT PERMIT US TO EXCLUDE.
23. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BOLTON AI STUDIO LLC, STARSTORY, AND THEIR MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO THE SERVICES OR A STARSTORY PRODUCT. TO THE FULLEST EXTENT PERMITTED BY LAW, STARSTORY’S AGGREGATE LIABILITY ARISING FROM A PARTICULAR ORDER OR THESE SERVICES WILL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID TO STARSTORY FOR THE ORDER GIVING RISE TO THE CLAIM. THESE LIMITATIONS DO NOT APPLY WHERE PROHIBITED BY LAW.
24. Indemnification
To the extent permitted by law, you hereby agree to defend, indemnify, and hold harmless Bolton AI Studio LLC, StarStory, and their members, managers, employees, contractors, agents, and affiliates from third-party claims, liabilities, damages, losses, and reasonable expenses arising from Customer Content you submitted, lack of authority to submit content, infringement of another person’s and/or business entity’s rights, unauthorized commercial use, or material violation of these Terms or applicable law.
Without limiting the foregoing, this indemnification includes third-party claims arising from a customer’s false representation that the customer is a parent or legal guardian, has parental or guardian authorization, owns or may lawfully submit content, or is authorized to request the particular personalized depiction or treatment of another person. This provision applies only to the extent permitted by applicable law.
25. Informal Dispute Resolution Required Before Arbitration
Before beginning arbitration or other permitted legal proceedings, you and StarStory agree to make a good-faith effort to resolve the dispute informally. A customer must first send written notice to support@getstarstory.com stating the customer’s name and contact information, the order number involved if applicable, a description of the dispute, the facts giving rise to it, and the requested resolution. Neither party, i.e., you or us, may initiate arbitration until at least 30 days after the other party receives written notice, unless the parties agree otherwise.
26. Binding Individual Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHT TO GO TO COURT. Except for disputes that applicable law does not permit to be arbitrated and other legally permitted exceptions, you and Bolton AI Studio LLC hereby agree that disputes arising out of or relating to these Terms, StarStory, an order, the website, or the Services that cannot be resolved informally will be resolved through small claims court in Miami-Dade County, Florida, should the claimed damages be less than or equal to the applicable maximum amount for such court’s jurisdiction. To the extent that the claimed damages exceed the applicable maximum amount for such court’s jurisdiction, you and Bolton AI Studio LLC hereby agree to binding arbitration rather than a lawsuit in federal or state court. Such arbitration will be administered by the American Arbitration Association (AAA) under its applicable Consumer Arbitration Rules, as modified by these Terms and permitted by law. The Federal Arbitration Act will govern the interpretation and enforcement of this arbitration agreement. Nothing prevents either party from bringing an eligible individual claim in small-claims court or seeking temporary or preliminary court relief where legally permitted.
27. Class-Action and Jury-Trial Waiver
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND BOLTON AI STUDIO LLC HEREBY AGREE THAT CLAIMS WILL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION. UNLESS BOTH SIDES AGREE OTHERWISE IN WRITING, AN ARBITRATOR MAY NOT COMBINE THE CLAIMS OF MORE THAN ONE PERSON. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND STARSTORY EACH WAIVE THE RIGHT TO A TRIAL BY JURY FOR DISPUTES SUBJECT TO ARBITRATION.
28. Governing Law and Permitted Court Proceedings
These Terms and your use of StarStory Services are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where federal law controls. For court proceedings for disputes not covered by Sections 25 through 27 of these Terms, you and Bolton AI Studio LLC agree to the jurisdiction and venue of appropriate state or federal courts located in Miami-Dade County, Florida, except where applicable consumer law requires otherwise. BOTH YOU AND BOLTON AI STUDIO LLC HEREBY IRREVOCABLY AND UNCONDITIONALLY WAIVES, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ANY RIGHT IT MAY HAVE TO A TRIAL BY JURY IN ANY LEGAL ACTION, PROCEEDING, CAUSE OF ACTION, OR COUNTERCLAIM ARISING OUT OF OR RELATING TO THESE TERMS AND/OR THE SERVICES PROVIDED BY BOLTON AI STUDIO LLC, OR THE ACTIONS OF THE PARTIES IN THE ADMINISTRATION, PERFORMANCE, OR ENFORCEMENT OF THESE TERMS.
29. Suspension or Refusal of Service
Bolton AI Studio LLC may refuse, cancel, restrict, or discontinue an order or access to the Services when we reasonably believe these Terms have been violated; content may violate law or another person’s rights; fraudulent payment activity is involved; or fulfilling the order could create a safety, privacy, intellectual-property, or legal concern.
30. Changes to the Services
Bolton AI Studio LLC may modify features, production methods, technologies, pricing, product offerings, policies, or other aspects of the Services from time to time. Changes will not retroactively take away rights already granted for a completed purchase except where necessary to comply with law or protect the security or integrity of the Services.
31. Changes to These Terms
We may update these Terms periodically. When we make material changes, we will update the “Last Updated” date and provide any additional notice required by law. The version in effect when you place an order will generally govern that order unless applicable law requires otherwise.
32. Force Majeure
StarStory will not be responsible for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, severe weather, fire, war, civil disturbances, labor disruptions, widespread internet or telecommunications failures, utility outages, government action, failures of third-party technology providers, cyber incidents not caused by our failure to use reasonable safeguards, or similar events.
33. Severability
If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as necessary, and the remaining provisions will continue in effect.
34. No Waiver
If StarStory does not immediately enforce a provision of these Terms, that does not waive our right to enforce it later. A waiver on one occasion does not constitute a continuing waiver.
35. Assignment
You may not assign or transfer your rights or obligations under these Terms without our written consent. Bolton AI Studio LLC may assign these Terms in its sole discretion in connection with a merger, acquisition, reorganization, sale of assets, change in control, or any other business transaction, subject to applicable law.
36. Entire Agreement
These Terms, together with the StarStory Privacy Policy and any additional terms expressly presented in connection with a purchase or feature, constitute the agreement between you and Bolton AI Studio LLC relating to the Services.
